1.   Personal Use Only:  The Software is made available to you for your personal, non-commercial use only. This means that you may use it at work or at home to help identify and prevent unwanted email from filling up you email Inbox.   

2.  Comments:  If you have any comments about the Software or ideas on how to improve it, you can email them to TMAntiSpam@trendmicro.com.  Note, however, that we cannot treat anything you email us as confidential.  Therefore, by providing Trend Micro with this information, you grant Trend Micro (or other parties) permission to use and incorporate your ideas or comments into the Software or other products without compensation in exchange for the right to use the Software for free under these Terms and Conditions. 

3.  Ownership:  You acknowledge that the Software is licensed, not sold, and that no title to the Software or any intellectual property therein is transferred to you and all rights, title, interest and ownership rights in and to the Software will remain the exclusive property of Trend Micro (or its licensors). You do not acquire any rights to the Software except as expressly set forth in the Terms and Conditions.  To the extent legally permissible, you agree that you will not attempt to rent, lease, sub-license, loan, auction, deal in, modify, create derivative works of, adapt, merge, translate, reverse compile, de-compile, or disassemble the Software, in whole or in part, use the Software to provide services to third parties, or authorize others to do any of the foregoing. You also agree to not remove, obscure, or alter Trend Micro�s or any third party's copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Software.

Disclaimer of Warranties: NEITHER TREND MICRO NOR ITS SUPPLIERS WARRANT THAT THE USE OF SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT USE OF THE SOFTWARE WILL KEEP YOUR NETWORK OR COMPUTER SYSTEMS FREE FROM ALL UNWANTED EMAIL OR SPAM. THIS LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF ANY DIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE TERMS AND CONDITIONS OR THE DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF TREND MICRO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE NATURE OF THE CAUSE OF ACTION OR THEORY ASSERTED. 

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THE ABOVE DISCLAIMERS OF WARRANTIES AND LIMITS ON LIABILITIES MAY NOT FULLY APPLY TO YOU. YOU MAY HAVE ADDITIONAL RIGHTS AND REMEDIES THAT MAY VARY FROM JURISDICTION TO JURISDICTION. SUCH POTENTIAL RIGHTS OR REMEDIES, IF ANY, SHALL NOT BE AFFECTED BY THE TERMS AND CONDITIONS.

General Provisions:  These Terms and Conditions will be governed by and construed in accordance with the laws of the State of California, without giving effect to the conflict of laws provisions of California or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of these Terms and Conditions to be unenforceable, the remainder of these Terms and Conditions will continue in full force and effect. 

These Terms and Conditions constitute the entire agreement between you and Trend Micro with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these Terms and Conditions will be effective only if in writing and signed by Trend Micro and/or a third party who make its software available in conjunction with or through the Software.
